Coal plant battle moves into federal court

The battle over coal-fired power plants in far west Kansas came to Wichita on Thursday, with a lawyer for Sunflower Electric Power Corp. telling a federal judge the state violated the company’s constitutional rights by rejecting plans for generating stations near Holcomb.
A lawyer for the state countered that environmental officials had every right to reject air-quality permits for the power plants because they would spew millions of tons of carbon dioxide into the atmosphere.
Carbon dioxide is not formally regulated as a pollutant under Kansas law, but the gas has been linked to global climate change and the U.S. Supreme Court has ruled that it should be considered a pollutant.
Sunflower’s federal suit is part of a multipronged effort in the courts and state Legislature to overturn the decision by Kansas Department of Health and Environment Secretary Rod Bremby. Also named as defendants in the suit are Gov. Kathleen Sebelius and Lt. Gov. Mark Parkinson.
U.S. District Court Judge Eric Melgren set Thursday’s hearing for arguments on the state’s motion to dismiss the case.
